These terms apply to all contracts of mbDESIGN GmbH & Co. KG (hereinafter “Seller”).
They apply to consumers and businesses.
§ 2 Contract
Shop listings are non-binding.
Contract is concluded upon confirmation or delivery.
§ 3 Prices
Prices valid at time of order apply.
VAT included (consumers) or excluded (businesses).
Shipping costs apply separately.
§ 4 Delivery
Delivery times are non-binding.
Partial deliveries are allowed.
§ 5 Transfer of Risk
Businesses: upon shipment.
Consumers: upon delivery.
§ 6 Retention of Title
Goods remain property of Seller until fully paid.
§ 7 Withdrawal (Consumers)
Consumers have a statutory right of withdrawal.

§ 8 Custom Products

- Customer responsible for specifications
- No liability for incorrect specifications
§ 9 Warranty
Consumers: statutory rights
Businesses: 12 months
§ 10 Product Use
Products are intended for road use only.

- Track use
- Extreme stress
is at the customer’s own risk.
Seller assumes no liability for such use.
§ 11 Liability
Unlimited liability for intent, gross negligence, injury and product liability.
Otherwise limited to foreseeable damages.
§ 12 Returns (B2B)
Returns require prior approval.
§ 13 Data Protection

§ 14 Final Provisions
German law applies.
